When Do I Need an Attorney in a Workers' Compensation Case?

Not every workplace injury requires a lawyer. If you tweaked your back, missed a couple of days, healed fully, and your employer handled everything without a fuss, you may never need one. But many claims are not that simple, and there are clear signs that tell you it is time to get help.

Signs You Should Talk to an Attorney

  • Your claim was denied. If the insurer refuses to pay, disputes that the injury is work-related, or stops your benefits, you should not try to fight that alone.
  • Your benefits are delayed. Late or missing checks and stalled approvals for treatment are often a signal that the insurer is not taking your claim seriously.
  • Your injury is disputed. When there is disagreement about how the injury happened, whether it is connected to your job, or how serious it is, the case becomes a legal fight, not just paperwork.
  • Your injury has permanent effects. If you are left with a lasting impairment, the value of your claim rises significantly, and so does the insurer’s incentive to pay you less than it is worth.
  • Your employer is pressuring you. Being pushed to return early, to use your own insurance, or to downplay the injury is a warning sign.

What an Attorney Actually Does

A workers’ compensation attorney handles the parts of the case that trip people up. That includes gathering the right medical evidence, making sure your wage rate is calculated correctly, dealing with the insurer, and, when necessary, taking the dispute before the Illinois Workers’ Compensation Commission. In cases involving a permanent injury, the difference between an unrepresented worker’s outcome and a well-supported claim can be substantial.

There is also little downside to asking. Workers’ compensation attorneys typically work on a contingency basis, and fees in these cases are regulated, so you generally do not pay out of pocket up front.
