What to Do If My Boss Retaliates for My Workers' Comp Claim

Filing a workers’ compensation claim is your legal right. Your employer is not allowed to punish you for exercising it. Yet some workers hesitate to report an injury because they fear losing their job or being pushed out. Illinois law takes that fear seriously and gives injured workers real protection against retaliation.

What the Law Protects

Illinois recognizes a claim for retaliatory discharge. In plain terms, an employer cannot fire you because you filed, or intend to file, a workers’ compensation claim. This protection exists because the workers’ compensation system would mean little if employers could quietly terminate anyone who used it. Retaliation can also take forms short of firing, such as a sudden demotion or a campaign of harassment meant to force you out.

Signs of Retaliation

Retaliation is not always obvious, but common warning signs include:

  • Being fired, demoted, or reassigned soon after you report an injury or file a claim.
  • A sudden drop in hours or a cut in pay with no legitimate explanation.
  • Discipline for things that were never a problem before your injury.
  • Pressure to withdraw your claim, use your own health insurance, or say the injury did not happen at work.

Timing matters. When an adverse action follows closely on the heels of your claim, that connection can be powerful evidence.

Document Everything

If you suspect retaliation, careful records are your best friend. Keep copies of performance reviews, pay stubs, schedules, emails, and text messages. Write down conversations while they are fresh, including dates and who was present. If your treatment on the job changed after you reported your injury, note exactly what changed and when.

A retaliatory discharge case is separate from your underlying workers’ compensation claim, and it can entitle you to remedies the comp system does not provide. Do not quit in frustration before you understand your rights, because that can complicate things.
